Terms of Service

These terms set out how we work together. They are written to be clear, not clever.
1. Agreement to Terms
These Terms of Service govern your use of arcadigitalph.com and the services provided by ARCA Digital PH, together with any Project Proposal or Statement of Work (“SOW”) we both approve. By using our website or engaging our services, you agree to these terms.
2. Scope of Services
- Managed Tech & Ops Teams: ongoing operations, updates and automations.
- Websites & Launch Funnels: fixed-scope builds, with launch funnels starting at $995 and custom 5-page sites starting at $1,495.
- Organic & AI Search (SEO).
Net-new, full website builds are scoped as standalone projects, or paced progressively across your monthly hours as agreed on the project board.
3. Billing, 60-Day Rollover, Kickstart Bonus & Cancellation
- Managed Tech & Ops plans are billed monthly in advance (from $495/month for 20 hours). There are no lock-in contracts, and you may cancel anytime before your next billing cycle.
- Rollover: unused hours roll over for up to 60 days on active monthly plans, and expire when a plan is cancelled.
- Month-1 Kickstart Build Bonus ($495 value): included for new monthly plan clients. It is a choice of one Lead Magnet Mini-Funnel or one Custom Time-Saving Workflow Automation, delivered in the first 14 days. It has no cash value.
- SEO plans are billed monthly in advance (from $799/month) with a 3-month initial minimum commitment, then month-to-month.
4. 30-Day Money-Back Guarantee
The guarantee applies to the first 30 calendar days of a client’s initial Managed Tech & Ops monthly subscription. To request a full refund of the first month’s fee, email hello@arcadigitalph.com in writing within that period. It does not apply to completed fixed-price website or funnel projects, or to third-party software or advertising spend.
5. Client Responsibilities & Third-Party Tools
You are responsible for maintaining the licenses, subscriptions and hosting for your own tools (for example WordPress, Kajabi, Shopify and Zapier), and for giving us timely access, information and approvals so we can do the work.
6. Intellectual Property
On full payment, you own 100% of the custom websites, funnels, copy and automations we build for you. ARCA retains the rights to its internal SOP templates, and may display completed work in its portfolio unless we agree otherwise in writing.
7. Confidentiality & Clinical Boundaries
Both parties agree to keep each other’s confidential information strictly confidential. Clinical and HIPAA-compliant healthcare engagements are routed through our sister studio, Ethos Digital.
We don’t host any client or medical information on our website or on the websites we build. Contact forms on client websites run through the client’s own SimplePractice or Hushmail account, integrated into their website.
8. Limitation of Liability
To the fullest extent permitted by law, ARCA Digital’s cumulative liability for any claim arising from our services is capped at the fees you paid us in the preceding three months.
9. Governing Law
These terms are governed by the laws of the Republic of the Philippines. Any dispute will be heard in the courts of General Santos City, Philippines.
